Property investment in Azerbaijan

Azerbaijan offers a foreign buyer near zero transaction taxes and full ownership of an apartment, house or commercial unit with no limit on the number held.

Strengths

  • Residency through a purchase starts at 100,000 AZN, about 59,000 dollars, one of the most accessible thresholds among property residency programs anywhere
  • Currency risk is modest, the manat has held a hard peg to the dollar since late 2017

What to keep in mind

  • The catch is structural: the land under the building does not belong to the foreigner, it comes on a long lease of up to 99 years
  • The country has no escrow institution for off-plan purchases
  • Price growth in Baku slowed sharply through 2025 after a strong prior year, and a mortgage is practically out of reach for a non-resident, so deals are almost always paid in cash
1 more
  • The economy still leans on oil, GDP growth is modest and inflation runs elevated

What a foreign buyer owns, and what stays leased

Can a foreigner own property here?

full ownership of an apartment, house or commercial unit, with no cap on the number held

Source: Norma.az

More detail

In Azerbaijan a foreign buyer gets full ownership of the building or the flat itself, but not of the land beneath it: the plot stays with the state or the municipality and is only handed over on a long lease. The split works the same way nationwide, unlike a designated-area system, and it is worth keeping in mind from the first negotiation.

Ownership right on the building
full ownership of an apartment, house or commercial unit, with no cap on the number heldThe only limit is on land: the plot under the property stays with the state or municipality and is handed over on a lease of up to 99 years, not as ownership.

Source: Norma.az

Agricultural land
not sold directly to a foreignerOnly a long lease or ownership through a company registered in Azerbaijan is available, a more complex route that needs local legal support.

Source: Jarniascyril

Land: a lease right only
foreigners, stateless persons and foreign companies may acquire land plots only under a lease rightThis is not a permit regime with exceptions but a direct bar on ownership: land is not available to a foreigner as property at all, and buying in one's own name does not get around it.

Source: State Property Service of the Republic of Azerbaijan

The land under a purchased building
is leased to the buyer by operation of law itselfThree provisions of the Land Code add up to one picture. Under article 88.4, when a building or an enterprise is sold to a foreigner the plot underneath is leased to them - the same rule shows that selling the structure itself to a foreigner is lawful. Under article 86.3 land may be sold only to the state, municipalities, and citizens and legal entities of Azerbaijan. Under article 49.4 a plot passing to a foreigner by inheritance, gift or a mortgage transaction must be disposed of within one year, or it is bought out compulsorily.

More detail

At the point of the deal the tax load in Azerbaijan is among the lowest in the region: there is no stamp duty and no transfer tax. The load shows up later, on rental income and on resale, and it is worth budgeting for from the start too.

Stamp duty and transfer tax

VAT on a housing deal
not confirmed by any rule either as zero or as a rate; the country's general VAT rate is 18 percentThe Tax Code list of exemptions carries no general exemption for housing, but neither is there an express rule saying that a sale of housing by an individual falls outside VAT in the tax service documents available. So on a commercial unit or a deal involving a company the rate has to be checked before signing rather than assumed to be zero. What is confirmed: a sale of housing by an individual is taxed by a simplified tax on area, set out in its own entry in the frequent questions section.

Source: State Tax Service of the Republic of Azerbaijan

Tax on rental income
10 percent withheld at source on residential tenancy (kirayə) and 14 percent on lease (icarə)The reduced rate comes from Law No. 297-VIIQD of 9 December 2025 and applies from 1 January 2026; the presidential decree it is usually credited to merely brings the law into force. The reduction covers residential tenancy only: the same provision keeps 14 percent for lease. Where the payment is made by an individual not registered as a taxpayer, the landlord or an appointed tax agent pays the tax. None of this cancels the duty to declare the income in the investor's own country of tax residence.

Source: State Tax Service of the Republic of Azerbaijan

Annual property tax
0.4 manats per square metre a year in Baku, 0.1 to 0.3 manats elsewhere in the countryThe tax is local and falls on residents and non-residents alike who own buildings. Rates: Baku 0.4; Ganja, Sumgayit and the Absheron district 0.3; other towns and district centres 0.2; settlements and villages subordinated to towns 0.1. On residential space only the part above 30 square metres is taxed, and with several flats those 30 come off each one separately. In Baku a zonal coefficient in the range 0.7 to 1.5 applies on top of the rate, under a Cabinet of Ministers decision.

Source: State Tax Service of the Republic of Azerbaijan

Tax on resale
no separate capital gains tax, the gain is folded into the individual ordinary taxable incomeIn practice, for an individual selling a home this means not a percentage of the gain but a simplified tax computed from the area and the location of the unit. Its rate, coefficients and exemption are set out in the fact below. A check with a local tax adviser before the deal is still mandatory: non-residential units and deals involving a company follow a different regime.

Source: PwC Tax Summaries

Simplified tax on a home sale
floor area in sq m, multiplied by the zonal coefficient and by 15 manatsBaku coefficients run from 4.0 in zone one and 3.0 in zone two down to 2.2 in zones three and four, 1.8 in five and six, 1.5 in seven to nine and 1.2 in ten to twelve. Ganja, Sumgayit and Khirdalan are 1.5. A separate band at 1.2 covers the settlements and villages of the Absheron district other than Khirdalan, plus Shirvan, Mingachevir, Nakhchivan, Lankaran, Yevlakh, Shaki and Naftalan; it is often skipped, and the resulting estimate is then off by a factor of four. All other districts, towns and settlements are 0.3. For non-residential space an additional increasing coefficient of 1.5 applies. The exemption goes to a seller who was registered at their place of residence in that housing unit for at least three calendar years - registration, not the length of ownership: an owner of ten years without that registration does not get the exemption. The exemption does not extend to land plots or non-residential premises.

Residency through a purchase

Does a purchase grant residency?

100,000 AZN

from 100,000 AZN, about 59,000 dollars

Source: Caspian Legal Center

More detail

Property in Azerbaijan does not grant citizenship and does not by itself make the buyer a tax resident. It grants a renewable residence permit tied to holding the property: sell it, and the status goes with it.

Temporary residency threshold
from 100,000 AZN, about 59,000 dollarsThe value of the land does not count: it does not belong to the foreigner, only the value of the building itself is measured. The terms of the status sit in a separate line below, on the migration service's own figures.

Source: Caspian Legal Center

Permanent residency threshold
from 200,000 AZN, about 120,000 dollars, after two years of residence on the temporary statusThe residence permit terminates automatically on sale of the property - the status is tied to ownership, not granted once and kept forever.

Source: Accounting.az

Terms of the status
temporary residence for up to one year, extendable, up to two years in total; permanent residence for five years, extendable by another fiveThe terms come from the migration service itself, from its own list of grounds and conditions of residence. The status is tied to ownership: selling the property ends it regardless of how much of the term was left.

How the deal runs

How does the deal run?

deposit up to 5 percent, title registration up to 10 working days

Source: EMZE Law

More detail

A deal in Azerbaijan is built around the notary and state registration, not around a protected account: there is no escrow institution for construction-stage payments in the country. This is the main difference from markets like the UAE, and the first thing to check on an off-plan unit.

Deposit and registration
deposit up to 5 percent, title registration up to 10 working daysRegistration is run by the State Real Estate Registration Service, the clock starts from the filing of the complete document package.

Source: EMZE Law

Escrow at construction stage
no escrow institution or buyer deposit protection existsThe risk of developer insolvency during construction falls directly on the buyer - there is no protection equivalent to Western jurisdictions or to the UAE mandatory escrow.

Source: VLO Law Firm

Occupancy permit
a mandatory condition for registering the building as a real estate assetWithout it the property cannot legally be sold, mortgaged or let as a registered asset, a second practical gate in the deal besides title registration itself.

Source: VLO Law Firm

The notary is mandatory
a contract disposing of a registered property is invalid without notarisationThe notary must verify the disposing party's right and the lawfulness of the contract, and bears responsibility for an incorrect certification: not a formality but the first title check in the deal. Notarisation is dispensed with only where the acquirer relies on a court judgment in force or an equivalent document. Separately: notarising contracts over property that is not in the state register is prohibited, and contracts concluded over such property are deemed invalid.

Source: Cadastre and Register of Immovable Property of the Republic of Azerbaijan

When the right arises
possession and use from notarisation, disposal only from the date of entry in the registerBetween those two dates the property can already be used, but it cannot be sold, mortgaged or given away. The registration term itself sits in the line above, so a resale has to be planned from the date of entry in the register, not from the date of signing at the notary.

Source: Cadastre and Register of Immovable Property of the Republic of Azerbaijan

  1. Sign a preliminary sale agreement before a notary, the deposit is usually no more than 5 percent.
  2. Agree and sign the main sale agreement.
  3. File the complete document package with the State Real Estate Registration Service.
  4. Wait for title registration - it takes up to 10 working days from filing the complete package.
  5. On an off-plan unit wait for the occupancy permit: without it the building cannot be registered, sold, mortgaged or let as a registered property.

Money

Cost of money and of holding

A non-resident mortgage in Azerbaijan formally exists, but is practically out of reach, so the overwhelming majority of foreign deals are paid in cash. The one-off costs of the deal, on the other hand, are known exactly and in advance: fixed manat amounts, not percentages of the price.

Cost of money and of holding

Notarising the dealin Baku 322 manats (280 plus 42), in Sumgayit, Ganja and the Absheron district 225.40 manats (196 plus 29.40), in other towns and districts 161 manats (140 plus 21)This is the rate for an ordinary purchase, where the property passes to an unrelated person. The notary's service fee is 15 percent of the duty precisely because certifying a sale and purchase agreement is a transaction (under the Law on Notaries, such services are charged at 15 percent of the duty). The full duty amount is charged not for certifying a transaction but for other notarial acts - certifying copies and extracts, the authenticity of signatures, the correctness of translations. Territory changes the duty itself: 100 percent of it is paid in Baku, 70 percent in Sumgayit, Ganja and the Absheron district, and 50 percent in the remaining regions. The final totals for all three territorial groups are confirmed directly by the ASAN xidmet service page, with no calculation on our part: Baku 322 manats (a 280 manat duty plus a 42 manat service fee), Sumgayit, Ganja and the Absheron district 225.40 manats (a 196 manat duty plus a 29.40 manat service fee), other towns and districts 161 manats (a 140 manat duty plus a 21 manat service fee). Where the property passes to a spouse, children, parents, grandparent, grandchild, brother or sister the duty in Baku is 25 manats, the service fee 3.75 manats, 28.75 in total. For handing residential premises into temporary use the duty is 35 manats and the fee 5.25, 40.25 in total. The service fee in all three cases is 15 percent of the duty.Source: ASAN xidmet

Yield

Rental yield and leasing

There is no official rental yield statistic in Azerbaijan, but the rents themselves have been published since May 2026 by the Chamber of Appraisers of Azerbaijan: its monthly indices and medians sit below, each linked to the specific issue. The series is young and covers the capital with its adjoining zones rather than the whole country. Market estimates of yield for Baku put gross return at roughly 5 to 8 percent a year, while a separate Central Bank metric, the real estate capitalization period, corresponds to about 4.8 percent.

new builds 97.8, individual houses 209.5, commercial 97.1 in July 2026, against a December 2025 base of 100The source is the Chamber of Appraisers of Azerbaijan, monthly real estate market index; the district breakdowns of the issue cover not only the city but also Absheron, Khirdalan and Sumgayit. The individual-house index is 209.5, while 109.5 percent is how far it stands above the base: two different numbers that sit side by side in one paragraph of the source. The report's change field is measured against the December 2025 base, not against the previous month. Month on month, per the text of the same issue, new builds lost 3.2 percent, commercial 7.4 percent, and individual houses corrected 1.8 percent downwards.

Median rent
10.59 manats per sq m a month for new builds, 15.71 for individual houses, 14.81 for commercialChamber of Appraisers of Azerbaijan figures for July 2026. On the metric card the source rounds the median to one decimal, the report text gives two: 10.6 against 10.59. Coverage is the capital with its adjoining zones rather than the country: the district breakdowns of the issue include Absheron, Khirdalan and Sumgayit.

The month by month series
May, June and July 2026 are all there is: the reports carried no rental section before MayNew builds: index 101.6 at a median of 11.0 manats per sq m in May, 101.0 at 10.94 in June, 97.8 at 10.59 in July. Individual houses: 166.7 at 12.5 in May, 213.3 at 16.0 in June, 209.5 at 15.71 in July. Commercial: 106.4 at 16.2 in May, 104.9 at 16.0 in June, 97.1 at 14.81 in July. Three points do not make a yearly picture, and an index for houses more than doubling against the base looks like a change in sample composition rather than a doubling of rents: the source does not disclose its method, so the figure is given as published and no conclusion is drawn from it. The segment set shifts between issues, and the secondary-housing segment in this series is not worth leaning on: its May and June values match to the decimal. Each month comes from its own issue: all three addresses sit as links under the introduction to this section rather than being collapsed into the archive page.

Yield is not in the reports
the Chamber of Appraisers issues carry no rental yield metric, and the line that looks like one means something elseThe Chamber's reports carry an indicative discount rate, and it is regularly mistaken for yield. It is a different thing: the gap between the seller's initial asking price and the current market level. We found no official state statistic on rental yield for Azerbaijan at any data holder, so any yield figure here is a private aggregator's estimate and has to be presented as an estimate.

Risks

What can go wrong

The risks of the Azerbaijan market split into two different kinds: the legal risk of the construction stage and the country macroeconomic dependence on oil.

The main legal risk was already named above: without escrow the buyer money on an off-plan deal goes straight to the developer, and in case of the developer insolvency there is no protection comparable to Western jurisdictions.

More detail

The practical conclusion is the same as on any market without escrow: check the developer track record and the actual construction progress, not only the paper permits, and do not prepay without confirmed progress.

The second risk is macroeconomic.

GDP growth is modest and is estimated differently by the World Bank and by the country own government, and inflation runs above the nominal rental yield, which eats into the owner real return.

More detail

Both factors trace back to the oil and gas sector, and its cycle is worth keeping in the background of any multi-year yield estimate.

Below are the ones that change a decision rather than decorate it.

Risk 1

GDP growth

World Bank forecast of 2.7 percent in 2025 and 2.4 to 2 percent in 2026

The Azerbaijan government gives a more optimistic forecast - 3.5 percent for 2025 and 2.8 percent for 2026. The gap itself reflects the economy dependence on the oil and gas sector.

Source: Caucasus Watch

Risk 2

Inflation

5.5 percent in 2025, forecast to reach 5.8 to 6 percent in 2026

Rising food prices and utility tariffs are the main drivers. Inflation running above the average market gross rental yield means the owner real, not nominal, return is lower than the headline figure.

Questions

Frequent questions about Azerbaijan

How much tax is due when selling an apartment in Azerbaijan?
For an individual this is not a percentage of the gain but a simplified tax on area: the amount is the floor area in square metres times the zonal coefficient times 15 manats. Baku coefficients run from 4.0 in zone one and 3.0 in zone two down to 2.2 in zones three and four, 1.8 in five and six, 1.5 in seven to nine and 1.2 in ten to twelve. Beware: the tax service site still serves a 2019 booklet with a five-year term, and it is out of date.
Can foreigners freely buy property in Azerbaijan?
Yes, a foreigner can buy an apartment, house or commercial unit in Azerbaijan in full ownership, with no cap on the number of properties held and no residency or visa requirement. The only catch concerns land: the plot under the building is not sold to a foreigner, it stays with the state or municipality and is handed over on a lease of up to 99 years. Agricultural land stands apart, it is not sold directly to a foreigner at all, only a long lease or ownership through a company registered in Azerbaijan is available.
Can the whole deal be handled remotely, without a personal visit?
Yes, personal presence is not required: a foreigner can issue a notary certified power of attorney, and the representative signs the sale and purchase agreement and files the registration documents on their behalf. The state fee for certifying the power of attorney is modest, 5 manat for relatives or 10 manat for other persons, plus a small service fee. If the power of attorney is issued abroad, it typically needs an apostille or legalization and translation into Azerbaijani, adding a separate step before filing.
What's the right way to wire money for a purchase in Azerbaijan?
Property payments are treated as an ordinary currency operation carried out through authorized banks under the central bank currency regulation rules. To claim a partial VAT refund, payment must be a non-cash bank transfer to the seller's account, with the refund application filed with the tax authority within 90 days of payment. Separately, cash export limits apply: up to 10,000 dollars needs only a verbal customs declaration, 10,000 to 50,000 dollars needs a written declaration with proof of prior import, and larger amounts must go through a bank.
What taxes should a buyer and owner expect in Azerbaijan?
At entry the tax load is close to zero: no stamp duty and no transfer tax. The one-off costs are the notarial duty plus its service fee (322 manats in Baku, 225.40 in Sumgayit, Ganja and the Absheron district, 161 in other towns and districts, on an ordinary deal) and the register charges: 50 manats for the extract on registration of ownership, 75 for the technical documents and a 36 manat data-entry tariff for an apartment or an individual house. Ownership carries two payments. The first is the annual property tax, a local tax levied on residents and non-residents alike: in Baku 0.4 manats per square metre a year with a zonal coefficient, elsewhere in the country 0.1 to 0.3, with the first 30 square metres of housing exempt. The second is tax on rental income, and from 1 January 2026 there are two rates: 10 percent on residential tenancy (kirayə) and 14 percent on lease (icarə). On resale there is no separate capital gains tax: an individual pays a simplified tax based on the area and location of the unit, set out in its own question above. The VAT rate on a commercial unit or a deal involving a company has to be checked before signing: the Tax Code list of exemptions carries no general exemption for housing, and the general rate is 18 percent.
How do the different ownership forms available to a foreigner differ?
A foreigner can hold full ownership of a completed building, an apartment, house, commercial or industrial unit, with no limit on the number held. The land under it is not part of that ownership: the plot stays with the state or municipality and is provided separately, under a long lease of up to 99 years. Agricultural land is a separate case, not sold directly to a foreigner, only a long lease or ownership through a company registered in Azerbaijan is available, a more complex route needing local legal support.
How risky is it to buy off-plan housing?
Buying off-plan in Azerbaijan carries elevated risk: the country has no dedicated escrow institution or buyer deposit protection, unlike Western jurisdictions or the UAE mandatory escrow system. Money goes directly to the developer, and if it becomes insolvent the buyer has no comparable protection. A second practical gate is the occupancy permit: without it the building cannot be registered, sold, mortgaged or let as a registered real estate asset. The practical takeaway is the same as on any market without escrow: check the developer track record and the actual construction progress, not just the paperwork, and avoid paying upfront without confirmed progress.
How do renting out and managing a property actually work here?
A lease agreement can be concluded in simple written form, but notarization removes disputes over its evidentiary weight; the form requirement was clarified by a Constitutional Court decision of 11 June 2025. Notarizing a residential lease through ASAN costs a 35 manat state fee plus a 5.25 manat service fee, and requires consent from the spouse and adult family members registered in the home. For letting and running the property, a foreign owner in Baku can turn to specialized property management firms that handle leasing and building operation for residences, villas and office centers.
What ongoing costs come with owning the property?
Among confirmed official tariffs, water for households in Baku, Sumgayit, Khirdalan and Absheron district costs 1 manat per cubic meter (0.7 manat water supply plus 0.3 manat sewage), while in other regions it is 0.9 manat; the tariff has been unchanged since February 1, 2021. Electricity and gas costs depend on consumption and no fixed annual figure appears in the sources. An owner also bears building maintenance fees, cleaning, security, elevator, which vary by building class, but exact figures for these or for home insurance are not given in the available materials.
Am I allowed to live in the property myself, and on what basis?
Yes. Full ownership of an apartment or house gives the owner the right to use and live in it with no separate real estate permit needed - the land under the building does not belong to the foreigner and does not affect the right to live there. A separate matter is the visa regime: owning the unit does not by itself replace a visa for entry and stay in Azerbaijan. A purchase from 100,000 AZN only gives grounds to apply for a temporary residence permit for 2 years, renewable - a convenient but not mandatory route for long-term living.
How do I later sell the property?
A sale follows the same scheme as a purchase: the agreement is notarized, and title passes to the buyer only upon registration in the State Register of Immovable Property. Being personally present is not required, a notarized power of attorney works. A foreign owner sells under the same rights as an Azerbaijani citizen, except for the land, which is not owned. Currency law sets no restrictions on repatriating sale proceeds abroad, but for large cash withdrawals a bank may request documents confirming the source of funds.
What set of documents will I need for the deal?
To register the transfer of title you need: the buyer's passport, a notarized sale and purchase agreement, a notarized power of attorney if a representative acts on your behalf, proof of the state fee payment, and title documents for the property itself - for a new build this means confirmation of the developer's registered ownership and a certificate of full payment. Since the land does not belong to the foreigner, a separate lease agreement for the plot under the building is also drawn up. The exact list should be confirmed with the State Real Estate Registration Service in advance, as it can differ for a flat, a house or a commercial unit.
What currency risks does a buyer face here?
The manat has held a hard peg to the dollar at about 1.70 AZN since late 2017, so exchange rate swings for an asset held in manat are limited. The risk shifts elsewhere: the peg is backed by budget oil revenue, GDP growth is modest and rated differently by the World Bank and the government, and inflation runs around 5.5 percent with a forecast of up to 6 percent in 2026. For an investor this means the real, not nominal, rental return in manat can run lower than headline figures, and the peg's own resilience depends on the oil cycle.
Is it worth hiring a lawyer, and what does one actually check?
The law does not require hiring a lawyer: the deal is certified by a notary, and a foreign buyer's interests can be represented via a notarized power of attorney even without being physically present in the country. Even so, law firms working with foreign buyers strongly recommend separate due diligence - checking title, encumbrances and the developer's or seller's ownership documents, especially on an off-plan unit with no escrow protection. Fee rates for such a check are not published in open sources and depend on the volume of documents, according to local law firms as of 2026.
What rental yield can I realistically expect?
There is no official statistic on rental yield in Azerbaijan. According to market aggregators and industry overviews, gross residential rental yield in Baku runs at roughly 5 to 8 percent a year, with some sources citing over 10 percent for select properties. The Central Bank of Azerbaijan separately reports a real estate capitalization period of 20.9 years at end 2025, corresponding to a yield of about 4.8 percent, a close but not identical figure. From the gross yield, subtract the withholding tax on rental income - from 1 January 2026 that is 10 percent on residential tenancy and 14 percent on lease - and factor in inflation of around 5.5 percent, which eats into the real return.
What do guaranteed rental income programs actually look like?
There is no government guaranteed rental income program in Azerbaijan: the only official mechanism, run by the Mortgage and Credit Guarantee Fund, is a rent-to-own scheme for local citizens, not an investment yield product. In the market, some resort and aparthotel developers offer a model where an investor buys a unit and hands it to a hotel operator for rental management, but specific guaranteed percentages and terms are not disclosed in open sources. Such offers should be treated as marketing for a specific project rather than a market norm, according to available information as of 2026.
Do I need a visa to own property in Azerbaijan?
No, a visa or residence permit is not required to register ownership of a building or apartment: a foreigner can own property regardless of migration status, since ownership law does not tie holding a title to the visa regime. A visa is needed separately, for entering and staying in the country. Owning a property worth at least 100,000 AZN does give grounds to apply for a temporary residence permit, but that is an option, not a mandatory condition of purchase or ownership.

Where the data comes from

The market figures are the live Housebook catalogue aggregate for this country plus an external publisher's reading where one has been found and verified. The legal, visa and tax facts come from the country profile: every number names its source.

Methodology

The median and quartiles are computed over active catalogue projects with a known price per square metre. Prices are converted to dollars using a single exchange rate snapshot rather than a mix of dates, so the figures stay comparable.

How often it updates

The catalogue aggregates are recomputed every day. The country profile and the external readings are updated by hand: the date of the last check is shown next to every source in the list below.
